CAPTURE Privacy Policy

This Privacy Policy sets out the privacy policies and practices of the Simon Fraser University’s Capture Project (the “SFU Capture Project”) with respect to the collection, use, disclosure and safeguarding of personal information in connection with the www.thecaptureplatform.ca website (the “Site”). This Privacy Policy may be supplemented or modified by agreements entered into between you and the SFU Capture Project from time to time.

The SFU Capture Project is committed to protecting the privacy of the personal information with which it is entrusted. Use of the Site constitutes your agreement to the terms of this Privacy Policy and the SFU Capture Project’s use and disclosure of your personal information in accordance with this Privacy Policy and as permitted or required by law.

In this Privacy Policy, “personal information” means any information about an identifiable individual, as further defined under applicable Canadian laws.

Introduction

The SFU Capture Project provides the Site as an online repository of information, including summaries of community interventions and reports about the interventions and other intervention materials. The SFU Capture Project also provides the Site to allow Registered Users (as defined below) to network with each other through messaging functionalities.

Collection of Your Personal Information

The SFU Capture Project may collect and store your personal information in connection with your use of the Site or any services provided by the SFU Capture Project through the Site (the “Services”), which may include, without limitation, information provided in connection with the following activities:

  • Registering to become a registered user of the Site (a “Registered User”);
  • Completing the account profile for your account;
  • Providing comments, feedback, or submissions to the Site;
  • Subscribing to newsletters and other communications from the Site;
  • Sharing your own information with other Registered Users or visitors to the Site;
  • Networking on the Site with other Registered Users of the Site; and
  • Using any such other features of the Site that may be offered from time to time, which may require such information in order to utilize the features.

Personal and contact information that the SFU Capture Project may collect include your name, profile picture, password, email address, work address, work telephone number, and any other personal or contact information that you choose to include in your account profile, your submissions to the Site, or in any other communications to the SFU Capture Project.

You represent and warrant that you have the right and authority or have obtained all necessary consents to provide any information, including any personal information of another individual, which is provided by you to the SFU Capture Project.

The SFU Capture Project may also collect and store information about you that is not personal information, which may include, without limitation, the frequency of your visits to the Site, the routes by which you access the Site, use of links available on the Site, browser type, access time, IP address, referring website addresses, and such other data that your browser sends to every website that you visit. The SFU Capture Project or its service providers may process and use such data for various purposes, including, without limitation, analysis of the data for trends and statistics, development of the Site and the Site’s features and functionalities, and assessing patterns of use. This information is gathered by certain tools such as the use of cookies and is maintained, used, and disclosed in aggregate form unless otherwise stated.

Use of Your Personal Information

The SFU Capture Project will only use your personal information for the purposes it was originally collected, except with your consent or where required or permitted by law. Consent to your personal information being collected, used and disclosed may be express or implied, and given in writing, by using or not using a check-off box, electronically, orally, or by your conduct, including the use of the Site. Without limiting the generality of the foregoing, the SFU Capture Project may use your personal information in association with the following activities:

  • to provide you with information and other updates and notifications about the Site, including any changes in the Terms of Use or the Privacy Policy;
  • to contact you and to respond to any communications that you may have had with the SFU Capture Project ;
  • to troubleshoot problems with the Site;
  • to enforce the Terms of Use and/or the Privacy Policy;
  • as permitted by, and to comply with, any legal or regulatory requirements, orders, and guidelines; and
  • for any other purposes to which you consent.

Disclosure of Your Personal Information

The SFU Capture Project may disclose your personal information to others as part of its use of your personal information under Section 3 of this Privacy Policy. The SFU Capture Project may also disclose your personal information as follows:

  • to third party service providers and to affiliated entities in order to carry out work on behalf of the SFU Capture Project for the administration and operation of the Site;
  • to law enforcement agencies for the purposes of investigating fraud or other offences;
  • to legal, financial, insurance, and other advisors or in connection with the sale, reorganization, or management of all or part of its business or operations; and
  • as consented to by you from time to time, including to fulfill any other purposes that were not identified when the personal information was collected.

In all instances, the SFU Capture Project will require the party that receives your personal information to agree to protect the privacy of your personal information in a manner consistent with this Privacy Policy and in compliance with all applicable laws.

Security

The SFU Capture Project protects against the unauthorized access, use or disclosure, loss, misuse, and alteration of personal information with security measures appropriate to the sensitivity of the information, including through the use of physical, organizational, and technological measures and appropriate training of employees. However, it is possible that any information transmitted via the Internet may be read or intercepted by unknown third parties. If you have any questions about the security of personal information collected by the SFU Capture Project, please contact the SFU Capture Project’s privacy officer (the “Privacy Officer”).

Personal information about you collected by the SFU Capture Project is stored and processed in Canada. Service providers for the SFU Capture Project will be contractually required by the SFU Capture Project to store and process your personal information in Canada.

You acknowledge and agree that certain portions of the Site are not confidential and are available for public viewing. Personal information that you have chosen to be made publicly available in such portions of the Site will be accessible and viewable by other users of the Site. By making personal information publicly available where the Site allows you to do so, you consent to such disclosure and publication by the SFU Capture Project or its service providers and agents. The Terms of Use also contain provisions governing any information that you submit.

Access and Correction

You may use the functionalities offered by the Site or the messaging system on the Site notify the SFU Capture Project to modify or correct any of your personal information that is under the SFU Capture Project’s control.

Compliance and Complaints

You may also direct a written complaint regarding compliance with this Privacy Policy or any applicable privacy or data protection legislation to the Privacy Officer and, within a reasonable time upon receiving the written complaint, the Privacy Officer will acknowledge the complaint and conduct an investigation. Within a reasonable time of concluding the investigation, the Privacy Officer will inform you whether the complaint will be accepted or denied. If the Privacy Officer accepts the complaint, the SFU Capture Project will take the appropriate measures necessary to rectify the source of the complaint. If, at any time, you are not satisfied with the denial of the complaint or how the SFU Capture Project is dealing with your complaint, you can contact the Office of the Information and Privacy Commissioner of British Columbia at info@oipc.bc.ca

Retention of Your Personal Information

When appropriate, you are given the opportunity to (i) opt-out of receiving communications from the SFU Capture Project; (ii) prevent access to the personal and account information in your account profile; or (iii) elect to no longer receive Services from the SFU Capture Project. If you wish to opt-out of receiving further communications, please contact the SFU Capture Project by email or phone using the contact information provided below.

When you close your account (by signing in to the Site and editing your account profile), the SFU Capture Project will immediately prevent all access to the personal and contact information in your account profile. Any Submissions that you have made publicly available on the Site, including, without limitation, comment in forums and messages to other Registered Users, and any copies of your personal information will continue to reside on the Site. Upon your request to the SFU Capture Project by email or phone using the contact information provided below, your account profile may be re-opened at any time.

Notwithstanding the foregoing, the personal and contact information that you provide will be retained by the SFU Capture Project in accordance with applicable laws.

Cookies

Like many websites, the SFU Capture Project uses “cookies” to maintain a record of your visit to the Site. A cookie is a small text file that a web page server places in your computer’s storage. It can only be read by the server that sent the cookie to you. This information does not identify you personally. You have the ability to accept or reject cookies, and most web browsers accept cookies. If you choose to decline all cookies, you may not be able to use certain features or functionalities of the Site that depend on cookies. The Site is entitled to use cookies to deliver content according to your preferences and to save your password, if you choose, so that you are not required to re-enter it when you use the Site.

Third Party Sites

The Site may contain links to other websites. The SFU Capture Project is not responsible for the privacy practices or the content of such websites. You should review the privacy policies of the websites that you visit. This Privacy Policy applies solely to information collected, used and disclosed by the SFU Capture Project in connection with the Site.

Changes to Privacy Policy

The SFU Capture Project may update, change, modify, add or remove, or otherwise amend this Privacy Policy from time to time. The SFU Capture Project will notify you of such changes by posting the changes to the Site and such changes will apply to any personal information collected on or after the date posted. In some circumstances, the SFU Capture Project may require to you expressly agree or consent to specific changes to the Privacy Policy. This Privacy Policy was last updated ● 2011.

The SFU Capture Project has delegated a Privacy Officer with responsibility for ensuring that the SFU Capture Project complies with applicable privacy laws. The role of the Privacy Officer includes ensuring that every member of the SFU Capture Project understands their responsibilities with regard to privacy. The SFU Capture Project will make information about its privacy policies and information protection practices readily available upon request.
